Terms of Service

1. Who we are

Northstar Air Concierge (“Northstar,” “we,” “us”) is a private membership club and aviation concierge marketplace headquartered in Florida. Northstar is not a direct or indirect air carrier. We do not own, operate, manage, or control any aircraft. All flights surfaced through Northstar are performed by independent, FAA-licensed Part 135 air carriers or properly certified flight schools, each of which maintains full operational control of every flight.

2. What membership includes

Membership grants access to curated empty-leg notifications, shared-seat opportunities, partner experiences, and concierge intake. Membership dues do not include the cost of any flight. Flight pricing, federal excise tax (FET), segment fees, fuel surcharges, landing fees, catering, ground transportation, and any other operator-imposed fees are charged separately, typically directly by the operating carrier.

3. Member relationship with operators

When a member books a flight or seat sourced by Northstar, the resulting transportation contract is between the member and the operating carrier. The operator is the merchant of record for the flight, collects applicable FET, maintains operational control, and is solely responsible for safety, scheduling, crew, maintenance, insurance, and passenger handling. Northstar’s role is limited to sourcing and member coordination.

4. Fees, taxes & billing

  • Membership dues are billed monthly or annually via Stripe and are non-refundable once the billing period begins.
  • Annual plans renew automatically unless cancelled at least 14 days before renewal.
  • Flight charges, taxes, and service fees are assessed and collected by the operating carrier or, where applicable, by Northstar acting as a disclosed agent.
  • All prices are USD. Florida sales tax does not generally apply to club dues but may apply to certain partner experiences.

5. Availability & no guarantee

Empty legs, shared seats, aircraft types, and partner experiences are inherently subject to change. Availability, pricing, and schedules are not guaranteed and remain subject to operator approval, weather, mechanical, and regulatory factors. Northstar makes no warranty that any specific flight will operate.

6. Cancellation & refunds

  • Members may cancel future membership renewals at any time from their account.
  • Flight cancellation, change, and refund policies are set by the operating carrier and disclosed at the time of booking.
  • Partner experience refunds follow the cancellation policy disclosed on each experience listing.

7. Member conduct

Members agree to comply with all FAA regulations, operator policies, TSA security requirements, and reasonable crew instructions. Northstar may suspend or terminate membership for misrepresentation, abusive conduct, or conduct that exposes operators or other members to risk, with no refund of dues.

8. Limitation of liability

To the maximum extent permitted by law, Northstar is not liable for any loss, injury, delay, or damage arising from the operation of any flight, the acts or omissions of any operator or partner, or any event outside Northstar’s reasonable control. Northstar’s aggregate liability to any member is limited to the membership dues paid in the preceding twelve (12) months.

9. Dispute resolution

These Terms are governed by the laws of the State of Florida. Any dispute will be resolved by binding arbitration in Collier County, Florida, except that either party may seek injunctive relief in court for intellectual-property or confidentiality matters.

10. Trip-request marketplace

Our Quote My Trip feature is a sourcing tool: you submit trip parameters, and we forward them to independent operators who may respond with a quote. Northstar does not set pricing, hold funds, or guarantee that any operator will respond. If you accept a quote, the resulting transportation contract — including billing, FET collection, cancellation policy, and operational control — is solely between you and that operator. We do not act as an indirect air carrier under 14 C.F.R. Part 295.

11. Scenic flights & flight-school partners

Certain experiences are operated by flight schools or commercial operators under a Part 91.147 Letter of Authorization for sightseeing flights. These flights begin and end at the same airport and remain within a 25-nautical-mile radius. The pilot in command is FAA-certificated, current, and operating under the school's or operator's authority — not ours. Northstar does not provide flight instruction.

12. Partner application & operator vetting

Flight schools, owners, and operators who apply to partner with Northstar agree that we may verify their FAA certificate status, insurance coverage, and operational history before approval. Approval is at our sole discretion and may be revoked at any time. Approved partners agree not to misrepresent their certification, insurance, or aircraft to members sourced through Northstar.

13. California members

California residents are entitled to the protections of the California Consumer Privacy Act (CCPA) and related laws. We do not sell personal information. To exercise CCPA rights, email privacy@northstarairconcierge.com. Sightseeing and day-trip experiences sourced in California are operated by independent California-licensed operators; their terms and refund policies are disclosed on each listing.

14. Communications consent

By creating an account or submitting any form, you consent to receive transactional emails (account, booking, quote, empty-leg alerts you've opted into) and, if you opt in, marketing emails. You may unsubscribe from marketing at any time via the link in any email; transactional messages necessary to deliver the service will continue.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be emailed to members at least 30 days before they take effect. Continued use of membership after the effective date constitutes acceptance.
